Terms and Conditions of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using the SenkuMaps mobile application ("App") and any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User") and [Insert Company Name/Legal Entity] ("Company," "we," "us," or "our").

2. Eligibility and Account Access

2.1 Age Requirement

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2.2 Invite-Only Access

SenkuMaps operates on an invite-only basis. Possession of an invite code or QR code does not guarantee a permanent right to access. We reserve the right to revoke access, invalidate invite codes, or terminate accounts at our sole discretion without prior notice.

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Location Services and Privacy

3.1 Core Functionality

The Service requires access to your device's location data to function. By using SenkuMaps, you authorize us to collect, use, and share your location with your authorized "Crew" or friends within the App, in accordance with your privacy settings.

3.2 Ghost Mode & Background Updates

The App offers controls such as "Ghost Mode" to mask your location and toggles for background location updates. It is your responsibility to manage these settings. You acknowledge that if you enable background location, the App may collect data even when not in use, which may impact battery life and data usage.

3.3 Data Accuracy

We do not guarantee the accuracy, completeness, or timeliness of any location data, "Spots," or "Alerts" displayed on the map. GPS signals can be affected by environment, network, and device settings.

4. User Conduct and Restrictions

You agree strictly NOT to:

  • Use the Service to stalk, harass, threaten, or intimidate others.
  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to reverse engineer, decompile, or discover the source code of the App.
  • Use the Service to coordinate illegal gatherings or trespass on private property.

4.1 Driving Safety

WARNING: Do not interact with the App while driving or operating heavy machinery. You agree to obey all traffic laws and regulations. The Company is not liable for any accidents, damages, or violations resulting from distracted driving.

5. User-Generated Content (UGC)

5.1 Ownership

You retain ownership of the content you post, including "Spots," photos, "Alerts," and "Meetup" details ("User Content").

5.2 License

By posting User Content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute said content solely for the purpose of operating and improving the Service.

5.3 Prohibited Content

You may not post content that is violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic, or sexually suggestive. We reserve the right to remove any content that violates these Terms.

6. Real-World Interactions

6.1 Assumption of Risk

SenkuMaps facilitates real-world meetups and "drives." You acknowledge that meeting other users carries inherent risks. You are solely responsible for your interactions with other users.

6.2 Release

The Company does not screen users beyond the invite system. We are not responsible for the conduct of any user on or off the Service. You agree to release the Company from all claims, demands, and damages arising out of disputes with other users or real-world incidents.

7. Intellectual Property Rights

The App, including its visual interfaces, graphics, design, compilation, computer code, and branding ("SenkuMaps"), is the property of the Company and is protected by copyright, trademark, and other intellectual property laws.

8. Third-Party Services

The App may utilize third-party map data (e.g., Google Maps, Apple Maps, Mapbox). Your use of the App is also subject to the Terms of Service of these third-party providers.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law and Dispute Resolution
